These Terms and Conditions of Sale govern the use of the 'HoHoHoCall' service, published by Euphony AI.
By using this service, the user acknowledges having read and accepted these terms without reservation.

1. Purpose

These Terms and Conditions define the terms of the HoHoHoCall service, which allows you to organize a personalized call from Santa Claus for a child, relative, or any other person, for exclusively playful and festive purposes.

2. Service Description

The HoHoHoCall service allows in particular:

• Entry of non-sensitive information to personalize Santa's message (e.g. first name, age, gift wishes, etc.);
• Scheduling a live or delayed audio call;
• Text transcription, then response generation by language model providers, and Santa's voice synthesis;
• Option to receive an audio or text souvenir.

The service does not replace human contact and is offered for entertainment purposes only.

3. Price and Payment

The price of the service is indicated on hohohocall.com at the time of order.
Payment is processed securely via Stripe.
No card data is stored or processed directly by Euphony AI.

Once payment is validated, the order is processed immediately to schedule Santa's call.
In case of error or technical issue, you can contact hohohocall@euphonyai.fr for any modification or assistance request.

4. Terms of Use

The user agrees to:

• Not enter unnecessary or sensitive personal information (address, medical data, etc.);
• Use the service exclusively for personal, family, or recreational purposes;
• Not misuse the service for any illegal, abusive, or inappropriate purpose;
• Respect the availability hours and deadlines indicated on the site.

HoHoHoCall reserves the right to suspend any account or call in case of abusive use.

5. Children and Parental Consent

The HoHoHoCall service can be used for calls intended for children.
In this case, the order and consent must be made by a parent or legal representative.

Parents are invited to supervise the call and only provide information strictly necessary for personalization.

6. Recordings and Audio Souvenirs (MP3)

The user can choose, at the time of order, to receive a recording of the call in MP3 format.
This recording is only made with the explicit consent of the parent or user.
Audio files are securely hosted for a maximum of 30 days, then automatically deleted.
No reuse of recordings is made for commercial purposes or AI model training.

7. Personal Data and Privacy

Except for audio souvenirs (temporarily stored for up to 30 days as mentioned in section 6), Euphony AI does not retain voice data or call transcripts beyond their processing.
Audio and text streams are processed in real time by third-party providers, including language model providers, as well as transcription and voice synthesis solutions, solely to ensure the service operates.

These providers declare compliance with GDPR and offer data processing agreements (DPA).
Euphony AI ensures collaboration only with partners respecting applicable data protection laws and limits data retention to the strict minimum.

8. Liability

The service is provided 'as is', for entertainment purposes only.
Euphony AI cannot be held responsible for:

• Emotional or behavioral reactions of children during or after the call;
• Service interruptions due to technical failures of external providers;
• Inappropriate use of the service by a user.

However, Euphony AI undertakes to use all reasonable means to guarantee the security, confidentiality, and quality of the service.

9. Governing Law and Disputes

These Terms and Conditions are governed by French law.
In case of dispute, an amicable solution will be sought as a priority between the parties.
